1. Shipping & Geographical Delivery Restrictions
Physical order delivery and product shipping are strictly and exclusively available within the United States of America. We do not offer or fulfill international shipping outside of the United States. Any order submitted with an international delivery destination will be voided, cancelled, and refunded minus any non-refundable payment processing fees permitted under law.
All shipments are fulfilled via established commercial third-party carriers (such as USPS, UPS, or FedEx). Risk of loss and title for all purchased merchandise pass to the buyer immediately upon tender of the package to the carrier. Champions of Leisure LLC is not liable for carrier handling delays, lost packages, stolen packages post-delivery, weather disruptions, or incorrect shipping addresses provided by the customer during checkout.
2. Return, Refund & Repair Policy
All sales are strictly final. Due to the randomized nature of oyster diving and custom mounting of natural pearls into selected jewelry settings, items cannot be returned, cancelled, or exchanged once an order is placed or an oyster is opened.
We maintain rigorous standards of craftsmanship. We proudly offer repair services on jewelry items that have not suffered severe physical abuse or unauthorized tampering, provided at the sole cost of customer-covered round-trip shipping plus any applicable materials cost for replacement chains or mountings.
3. Pearl Odyssey Diving & Natural Pearl Characteristics
Every oyster opened in Pearl Odyssey guarantees at least one genuine AA+ cultured freshwater pearl. As organic gems harvested from freshwater mollusks, cultured pearls inherently display organic variations in shape, overtone, body color, surface luster, and dimensions (ranging from 6mm to 8mm). Natural variations, micro-blemishes, and slight irregularities are authentic hallmarks of genuine cultured pearls and shall not be deemed defects or grounds for returns or compensation.
4. Limitation of Liability & Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE, GAMEPLAY, OYSTER PICKS, AND ALL MERCHANDISE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. CHAMPIONS OF LEISURE LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
IN NO EVENT SHALL CHAMPIONS OF LEISURE LLC, ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE, VIRTUAL PICKS, PRODUCTS, OR ANY CARRIER TRANSIT ISSUES. CHAMPIONS OF LEISURE LLC’S TOTAL AGGREGATE LIABILITY ARISING UNDER ANY CLAIM SHALL BE STRICTLY LIMITED TO THE ACTUAL AMOUNT PAID BY YOU TO CHAMPIONS OF LEISURE LLC FOR THE SPECIFIC TRANSACTION GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100.00 USD), WHICHEVER IS LESS.
5. Indemnification
You agree to defend, indemnify, and hold harmless Champions of Leisure LLC, its owners, directors, officers, employees, and authorized agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees and court costs) resulting from or related to: (a) your use of the website or merchandise; (b) any breach or violation by you of these policies; or (c) any inaccurate information provided by you during registration or checkout.
6. Virtual Oyster Picks, Account Terms & Fair Play
Virtual oyster picks, gems, and digital reveals are entertainment features designed exclusively for use within the Pearl Odyssey platform. Virtual picks carry no monetary cash balance, are non-refundable, and cannot be redeemed for fiat currency or transferred between separate accounts. You are solely responsible for maintaining the confidentiality of your account password and all activities conducted under your credentials.
7. Email Communications & Marketing Opt-In
By electing to check the optional email marketing opt-in box during registration, you consent to receive promotional emails, game announcements, and seasonal discount opportunities from Pearl Odyssey. You may revoke this marketing consent at any time without affecting your account status by clicking the unsubscribe link present in every marketing email.
8. Governing Law & Jurisdiction
These policies and any disputes arising between you and Champions of Leisure LLC shall be governed by, and construed in accordance with, the laws of the United States and the state in which Champions of Leisure LLC is organized, without giving effect to any principles of conflicts of law. Any legal proceeding shall be instituted exclusively in the applicable courts of competent jurisdiction located within that state, and all parties irrevocably waive any right to trial by jury or participation in class-action proceedings.
